This paper is concerned with the position of a Roman paterfamilias with respect to his family's property in the period of the Republic. Rights over property are in Roman law strictly dominium and not potestas; but to understand the role of a family system in a society one must analyse how its property is managed and passed on.

Rejoinders to Robert Bishop, John Smythies, and Edmond Wright concerning my paper Phenomenology in Absentia: Dennett's Philosophy of Mind. The untoward social and moral consequences of Daniel Dennett's heterophenomenology are documented. Rhetorical methodology, fallacious reasoning, and lack of empirical support for a philosophical abolition of consciousness and phenomenology are exposed. Consciousness denial by Dennett is shown to proceed by the same fallacious method involved in his phenomenological nihilism. Additional arguments are adduced against the presumed nonexistence of veridical and non-veridical (...) percepts, as interpreted by elementary science of perception, and as this implicates a more general critique of naive realism and its applications to such hypothetical scenarios as our actual existence within cranial vats and the so-called inverted spectrum argument devolved from Locke. 2012 APA, all rights reserved). During the latter part of his career, Kant proposes three different accounts of evil. In these accounts are found psychological, logical, and teleological elements intetwoven in such a way as to give a coherent reading of evil as a complex philosophical issue. Recent commentators have emphasized one or the other of these two elements and consequently have only given a partial picture of Kant’s struggle with evil. I argue that Kant’s use of scripture needs to be taken much more seriously (...) than it has been taken in order to unify these psychological, logical, and teleological aspects of his treatment. John Anthony Crook, a Fellow of the British Academy, was a distinguished ancient historian with a special interest in Roman history and law. Among historians, his knowledge and understanding of Roman law was unequalled. Crook's academic career was spent for the most part in the University of Cambridge, and at St John's College. He entered the college as an undergraduate in 1939, and served as a Fellow from 1951 until his death on September 7, 2007. Within (...) the Faculty of Classics he rose to be Professor of ancient history in 1979. Crook was born in Balham, London, the only child of a bandsman in the Grenadier Guards. In his book Law and Life of Rome, he gave a brilliant demonstration of how legal sources might be made accessible and used constructively for social history. In the late 1970s, Crook joined forces with J. G. Wolf to produce an edition of the Murecine Tablets, to which they had been drawn independently. (shrink)

Mark Crooks effectively demolishes Dennett's theory by concentrating on its internal defects. In which case I would like to contribute to this discussion by examining some scientific evidence that may be relevant. Dennett claims that hallucinations do not involve any actual sensory element but only a change in our beliefs. A schizophrenic does not actually hear the voices he complains about--he develops the false belief that he is hearing something. This puts hallucinations on a par with the patient's delusions e.g. (...) his false belief that other people are persecuting him. The majority view, in contrast, is that hallucinations represent defective function in the sensory system. In this impasse, evidence from functional magnetic resonance imaging studies should help. These allow us to identify those areas of the brain that are activated under the conditions we are interested in. If the majority are right, then a subject having hallucinations should show increased activity in some part of his sensory brain. On the other hand, if Dennett is right, the subject should show no such increased activity but, instead, possibly abnormal activity in the part of the brain related to the formation of delusions. To answer this question I performed a Medline search of the literature on imaging studies in hallucinations occurring under various circumstances. From the viewpoint of its Stalinist-era creators, the IKKN/INS could at best be described as a mixed success. Despite heroic efforts, it failed to train the cadres that might have permeated Polish scholarship with Marxism-Leninism. If it was the major channel for transmitting Soviet experience to Polish academia, then Poland's universities would not learn to be Soviet—the Polish historian Jerzy Halbersztadt has made the point that the institute was the only direct conduit of Soviet experience into Polish academic life. It (...) even had a major role in educating some of Poland's most famous critical thinkers, although they, unlike their master Adam Schaff, seem less fond of reminiscing about the institute. Leszek Koŀakowski writes that he does not regard his role in the ideological struggles of the early 1950s as a “source of pride”.90The legacy of the IKKN/INS has also been a mixed one. It was not only a “foundry of revisionists”. For every future critical thinker of world repute, it graduated several cadres who served the PZPR loyally over decades. Adam Schaff recognises this dual legacy. Looking back on a long and active life, he has called the institute a “pearl in my crown”.91 Its members filled top party and government posts throughout the history of People's Poland. Andrzej Werblan served as Central Committee secretary and a member of the Politburo, Sylwester Zawadzki became minister of justice, Stanisŀaw Wroński was minister of culture, Mieczysŀaw Jagielski was the Politburo member who negotiated the Gdańsk accords, Stanisŀaw Kania succeeded Edward Gierek, and Mieczysŀaw Rakowski acted as General Jaruzelski's Party First Secretary.92Undoubtedly much of the institute's strange course is to be attributed to the designs of Adam Schaff. Despite his Moscow training, Schaff retained an attachment to the Polish academic milieu which had formed him. He may have believed in Stalinist doctrine, but he also believed that this doctrine would show its superiority in competition with other views—even if the competition was far from a fair one. Of course, Schaff tried to retain ultimate control, and to play, as he now calls himself, the “grey eminence”. Nevertheless, his was a very unstalinist way of propagating Stalinism, and he must be given credit for helping to keep a spirit of intellectual inquiry alive in Poland during the dark years of the early 1950s.Yet Schaff tends to exaggerate his personal role in educating philosophers, dissidents and critical thinkers. This tendency is itself a legacy of the Stalinist period and its concentration of power. Stalinists view the present as their personal creation and therefore reject all criticisms of the past. At the final meeting of the Crooked Circle Club in 1962, Schaff encountered unwonted criticism from, among others, Andrzej Walicki. Schaff shot back at him: “You are ours, you are our creation, a creation of socialism ... we educated you, and we didn't do such a bad job.” But far from being a “creation” of Schaff's, the non-party member Walicki had been denied admission to graduate studies in philosophy. He felt relieved when those in attendance, who knew him better than Schaff did, burst out laughing.93The point is that the Polish intellectual world maintained its integrity outside the IKKN/INS, and in the end it was the institute which merged into the Polish intelligentsia, rather than the opposite. After 1957 the non-Marxist sociologists and philosophers made their way back to academia, and were joined by many former INS staff members. The basic unity of Polish social science training, and of the Polish intelligentsia, was restored.94Of course in a larger sense the fate of the IKKN/INS had little to do with the designs of its master. Schaff admits as much, proclaiming that “I did this because I did not know what I was doing!” If he had been asked to start such a project five years later, the answer would have been: “No!”95 The fatal flaw of the Institute for Training Scientific Cadres was cadres: Poland did not have them. By 1956, Schaff and the party leadership, and perhaps Soviet advisers as well, had learned that one could not create an elite party scientific institution almost out of nothing. It would either be party or scientific, because apparatchiki could not become scientists, scientists would not become apparatchiki, and students could not produce teachers. In the Stalinist period, Polish intellectual life had stood in the shadow of the party; yet during the Thaw the relationship was reversed—increasingly the tiny party training institute was engulfed by the shadow of the resurgent Polish universities. Talented young people, even those in the party, made their way into the traditional higher educational establishment.The IKKN/INS did not, therefore, fail because of its own failings, nor succeed because of its own successes. It was a failed part of a failed whole. To succeed, “mild” revolution would have required decades, and Poland's Stalinists had only a few years. To make matters worse—or better, depending on viewpoint—they did not use these years in a conventional Stalinist manner. Under Schaff's guidance and at somewhat erratic Soviet bidding, the institute became an awkward series of half-measures, reminiscent of much of Polish Stalinism. When Poland's communists fell back and regrouped in 1956, the IKKN/INS occupied a lonely position they preferred to abandon. (shrink)

[Edited from Conclusion section:] We have looked at various challenging issues to do with getting connectionism to cope with high-level cognitive activities such a reasoning and natural language understanding. The issues are to do with various facets of generalization that are not commonly noted. We have been concerned in particular with the special forms these issues take in the arena of propositional attitude processing. The main problems we have looked at are: (1) The need to construct explicit representations of generalizations, (...) not just generalize correctly to individual cases; (2) The need to be able to match two or more complex short-term information structures, to enable rapid generalization from recent examples rather than from long-term memories; (3) The need to represent and reason with anomalous combinations of concepts; (4) The need to perform embedded reasoning. This presents special problems for systems using non-concatenative representations (as in mainstream connectionist approaches). We also touched on vague quantification in attitude report complements. Neither this topic nor that of analogies between short-term structures (point 2) has been adequately addressed in the symbolic framework, let alone in connectionism. -/- The opportunities and problems covered are put forward as things worth being optimistic about or pessimistic about, respectively. They are not put forward as decisive arguments for or against connectionism. The hope is that this chapter contributes to a greater understanding of the connectionist/symbolist gap by presenting some unusual issues and by throwing new light on some well known ones. (shrink)

Written as companion texts, the Bendō 弁道 and the Benmei 弁名 present Ogyū Sorai’s most mature and comprehensive expression of his philosophical thought. Sorai modestly spoke of the texts in a letter to a student, Uno Shirō 宇野士朗, calling them “my humble achievements”. In another letter to a student, Yamagata Shūnan 山県周南, Sorai related that after a prolonged bout with ill-health, he feared passing like the morning dew. Therefore, he took up his writing brush and completed the two works. Sorai (...) added that while more than a millennium had passed since Confucius’ death, the Way had only been clarified in recent times. Yet rather than boast of this, Sorai suggested that his hand in the process had been by heaven’s decree. With the two works, he added that even if he passed away soon, his life would not have been wasted. (shrink)

This paper explores Ogyū Sorai’s 荻生徂徠 thinking on the most sensational and controversial incident of eighteenth-century Japan, and perhaps the most well-known in all Japanese history, the forty-seven rōnin incident of 1701–1703. Viewed in relation to his lifework, Sorai’s views on the incident are significant insofar as they reveal the extent to which his philosophical thinking was occasionally shaped decisively by neither ancient Chinese nor later Confucian texts, Neo- or otherwise, but instead by formative life-experiences he had as a youth (...) living in exile. No doubt, Confucian and Neo-Confucian notions, which Sorai knew in-depth, helped him filter, epistemologically, events, issues, and most importantly what he understood to be righteous and just behaviour in a polity. Yet ironically enough, Sorai’s thinking on the rōnin incident shows that however philosophically erudite, cosmopolitan, and urbane he was as an intellectual, his appraisals of things sometimes harked back to rural experiences he had early on with some of the most primitive and foundational expressions of human agency, civilization, and socio-political ethics in early-eighteenth century Japan. In the process, Sorai’s essay reveals, through its later resonance with some Meiji thought, how his views on those same primitive expressions remained relevant even in modern contexts. (shrink)

On the life and philosophy of Ramana Maharshi and his views on Advaita and epistemology.

Closure is the epistemological thesis that if S knows that P and knows that P implies Q, then if S infers that Q, S knows that Q. Fred Dretske acknowledges that closure is plausible but contends that it should be rejected because it conflicts with the plausible thesis: Conclusive reasons (CR): S knows that P only if S believes P on the basis of conclusive reasons, i.e., reasons S wouldn‘t have if it weren‘t the case that P. Dretske develops an (...) analysis of knowing that centers on CR, and argues that the requirement undermines skepticism by implying the falsity of closure. We develop a Dretske-style analysis of knowing that incorporates CR, and we argue that this analysis not only accords with closure, but also implies it. In addition, we argue that the analysis accounts for the prima facie plausibility of closure-invoking skeptical arguments, and nonetheless implies that they are fallacious. If our arguments turn out to be sound, the acceptability of Dretske‘s analysis of knowing will be significantly enhanced by the fact that, despite implying closure, it undermines closure-based skepticism. GUM is a linguistically-motivated ontology originally developed to support natural language processing systems by offering a level of representation intermediate between linguistic forms and domain knowledge. Whereas modeling decisions for individual domains may need to be responsive to domain-specific criteria, a linguistically-motivated ontology offers a characterization that generalizes across domains because its design criteria are derived independently both of domain and of application. With respect to this mediating role, the use of GUM resembles the adoption of upper ontologies as tools (...) for mediating across domains and for supporting domain modeling. This paper briefly introduces the ontology, setting out its origins, design principles and applications. The example cases for this special issue are then described, illustrating particularly some of the principal differences and similarities of GUM to non-linguistically motivated upper ontologies. How, if at all, consciousness can be part of the physical universe remains a baffling problem. This article outlines a new, developing philosophical theory of how it could do so, and offers a preliminary mathematical formulation of a physical grounding for key aspects of the theory. Because the philosophical side has radical elements, so does the physical-theory side. The philosophical side is radical, first, in proposing that the productivity or dynamism in the universe that many believe to be responsible for (...) its systematic regularities is actually itself a physical constituent of the universe, along with more familiar entities. Indeed, it proposes that instances of dynamism can themselves take part in physical interactions with other entities, this interaction then being “meta-dynamism” (a type of meta-causation). Secondly, the theory is radical, and unique, in arguing that consciousness is necessarily partly constituted of meta-dynamic auto-sensitivity, in other words it must react via meta-dynamism to its own dynamism, and also in conjecturing that some specific form of this sensitivity is sufficient for and indeed constitutive of consciousness. The article proposes a way for physical laws to be modified to accommodate meta-dynamism, via the radical step of including elements that explicitly refer to dynamism itself. Additionally, laws become, explicitly, temporally non-local in referring directly to quantity values holding at times prior to a given instant of application of the law. The approach therefore implicitly brings in considerations about what information determines states. Because of the temporal non-locality, and also because of the deep connections between dynamism and time-flow, the approach also implicitly connects to the topic of entropy insofar as this is related to time. The representation of propositional attitudes (beliefs, desires, etc.) and the analysis of natural-language, propositional-attitude reports presents difficult problems for cognitive science and artificial intelligence. In particular, various representational approaches to attitudes involve the incorrect “imputation,” to cognitive agents, of the use of artificial theory-laden notions. Interesting cases of this problem are shown to occur in several approaches to attitudes. The imputation problem is shown to arise from the way that representational approaches explicate properties and relationships, and in particular from the (...) way they explicate propositional attitudes themselves. Another factor contributing to imputation is the compositional nature of typical semantic approaches to propositional-attitude reports. Some strategies for avoiding undesirable imputation are examined. One of the main conclusions is that the importance of imputations that arise in a representation scheme depends strongly on the use to which the scheme is put -- on whether, for instance, the scheme is used as part of a formal, objective account of natural language, or is used rather as a representational tool within an agent. But how those inmates experience that event is primarily controlled by correctional policies and by the prison medical and correctional staff assigned to their care. Compassion for inmates who are dying cannot be legislated or mandated, but humane and compassionate care for the dying can be facilitated or thwarted by legislative and correctional policies, and by the manner in which correctional (...) personnel interpret those policies.Death in New York State prisons is a frequent event, occurring at a rate substantially higher than that in most other states. I present considerations surrounding pre-reflective self-consciousness, arising in work I am conducting on a new physicalist, process-based account of [phenomenal] consciousness. The account is called the meta-causal account because it identifies consciousness with a certain type of arrangement of meta-causation. Meta-causation is causation where a cause or effect is itself an instance of causation. The proposed type of arrangement involves a sort of time-spanning, internal reflexivity of the overall meta-causation. I argue that, as a result of the account, any conscious (...) process has PRSC. Hence, PRSC does not need to be taken as a stipulation or argued for on purely phenomenological grounds or as a necessary support for reflective consciousness. I also show how it is natural to the account that PRSC is not an additional, peripheral, sort of consciousness, but is intrinsic to all consciousness, thereby fitting claims about self-intimation and co-constitution by various authors, and also being amenable to an adverbial account. As part of this, consciousness of an external object is just the form that current self-consciousness takes, the meta-causal constitution of it being inextricably modulated by the causal relationship with the object. The article also discusses how MCA helps explore issues of for-me-ness, transparency of perceptual consciousness, and possible immediacy and non-relationality of self-consciousness. (shrink)

The book is thought-provoking and informative, wide in scope while also being technically detailed, and still relevant to modem AI [at least as of 1998, the time of writing this review, but probably also at the time of posting this entry here, 2023] even though it was published in 1989. This relevance lies mainly in the book’s advocacy of distributed computation at multiple levels of description, its combining of neural networks and other techniques, its emphasis on the interplay between action (...) and perception, and its particular approach to natural language processing. The criticisms I have occasionally made above are relatively minor, and one of the major shortcomings of schema theory at least at the time of the book’s publication -- namely the lack of a detailed, preferably neural, mechanism for schema instantiation -- is one of which Arbib is well aware. The book is well produced, for the most part clearly written, and has useful summaries at the beginning of each chapter. Both general readers and AI researchers (mainly but not exclusively those working on robotics, vision and neural networks) could benefit from reading the book. (shrink)
